These terms and conditions of sale are entered into, on the one hand, by C O N T I  S T U D I O  &  D E S I G N, S.L., whose registered office is located in Riudellots de la Selva (Girona, Spain), registered in the Mercantile Registry of Barcelona in Volume 45783, Folio 71, Sheet 498855, Entry: 1  and with tax identification number B- 66 93 40 76, hereinafter referred to as “VOLTA Mobiles”, and operating the website www.voltamobiles.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.voltamobiles.com hereinafter referred to as " the buyer ". 

 

Article 1. Purpose 

These terms and conditions of sale are intended to define the contractual relationship between VOLTA Mobiles and the buyer and the conditions applicable to any purchase made through the website www.voltamobiles.com. The purchase of a product through this website implies the buyer’s unconditional acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the website www.voltamobiles.com is not directly related to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity allowing them to enter into these general terms and conditions of sale. VOLTA Mobiles reserves the right to amend these terms and conditions of sale at any time, in order to comply with any new regulations or for the purpose of improving the use of its website. Consequently, the applicable conditions shall be those in force on the date of the order by the buyer. 

 

Article 2. Products

The products sold on www.voltamobiles.com are described as accurately as possible. However, minor variations may exist (non-contractual photographs). Products are available while stocks last. In the event of stock shortages, VOLTA Mobiles will inform the Customer as soon as possible.

 

Article 3. Prices 

The prices shown on the product sheets in the online catalogue are prices in Euros (€), inclusive of all taxes (VAT included), taking into account the VAT applicable on the date of the order. Any change in the VAT rate may be reflected in the price of the products. VOLTA Mobiles reserves the right to change its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order shall be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are charged in addition to the price of the products purchased according to the total amount of the order.

 

Article 4. Orders and payment terms

Before placing any order, the buyer must create an account on the website www.voltamobiles.com. The account creation section is accessible directly from the side menu bar. On each visit, the buyer, if they wish to place an order or consult their account (order status, profile…), must identify themselves using these details.

The Customer selects the products they wish to order in the « basket », modifies them if necessary (quantities, references…), checks the delivery address or enters a new one. Then, shipping costs are calculated and presented to the Customer, together with the name of the carrier. The Customer may opt for secure payment by bank card. The next step allows the Customer to check all the information, read and accept these general terms and conditions of sale by ticking the corresponding box, and then confirm the order by clicking on « Confirm my order ». VOLTA Mobiles has chosen the secure Shopify Payments platform:

1. After validating the basket, the Customer enters their bank details on the Shopify Payments interface on the website www.voltamobiles.com.

2. The Customer confirms their secure payment.

If the payment is accepted, the order is recorded and the contract is definitively formed. In the event of refusal by the Customer’s bank, VOLTA Mobiles does not have access to the confidential reason for the refusal of payment. Exchanges between the Customer and the payment server are encrypted; VOLTA Mobiles has no access whatsoever to Customers’ banking data.

In the event of fraudulent use of the Customer’s bank card, cancellation of the card payment may be requested; the sums paid shall then be re-credited or refunded. The liability of the bank card holder shall not be engaged if the disputed payment is proven to have been carried out fraudulently, remotely, without the physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must dispute the debit, in writing, with their bank, within 70 days of the transaction, or even 120 days if the contract binding them to the bank so provides. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written dispute submitted by the card holder. No restitution fees may be charged to the holder

Article 5. Retention of title 

VOLTA Mobiles retains full and complete ownership of the products sold until full payment of the price, in principal, charges and taxes included. 

 

Article 6. Withdrawal 

The buyer has a period of 14 working days from delivery of the order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.

The returned products must be intact, in perfect condition for resale and complete, in their packaging. The order number together with the Customer’s preferred outcome (refund or exchange) must be enclosed with the returned products.

If all return conditions are met, the exchange or refund will be processed within a maximum period of 14 days after receipt of the return.

 

Article 7. Delivery 

7.1. Delivery charges

Products can be delivered within the European Union, to the United States, to Canada and to other specific countries. Products are delivered to the delivery address indicated by the Customer when placing the order; it is the Customer’s responsibility to check the validity of this address. For delivery of products to other countries, please contact us by e-mail at eshop@www.voltamobiles.com. 

Delivery charges are borne by the Customer. They vary depending on the weight and destination of the parcel and are indicated when the order is confirmed. Customs charges are not the responsibility of VOLTA Mobiles. The Customer must inform themselves about these before placing any order.

 

7.2. Delivery times

Delivery times are mentioned on the webpage describing the item and also appear in the order confirmation e-mail.

Dispatch times are from 1 to 4 working days, from receipt of payment, for products in stock. 

 

7.3. Delivery methods

Products are generally sent by UPS, but Volta Mobiles reserves the right to choose from among its partner carriers. VOLTA Mobiles may provide the buyer with the tracking number for their parcel by e-mail.

The usual delivery time of our partner carriers is 2 to 7 working days.

Delivery times are given for guidance only. The Customer is delivered to the delivery address indicated. In the event of absence, the Customer will receive a delivery notice allowing them to collect the ordered products from a collection point or rearrange the delivery, within the period indicated by the carrier. It is advisable to check the contents of the parcel in the presence of the carrier.

VOLTA Mobiles declines all liability in relation to any delays, theft, loss or damage to the parcel during transport. Risks relating to transport are borne by the Customer from the moment the items leave the premises of VOLTA Mobiles.

 

Article 8. Warranty 

All goods supplied by VOLTA Mobiles benefit from the statutory 2-year legal guarantee of conformity and the warranty against hidden defects.

In the event of non-conformity of a product sold, the Customer may return it and VOLTA Mobiles will proceed either with an exchange or a refund.

 

Article 9. Liability 

In the distance selling process, VOLTA Mobiles is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, interruption of service, or other involuntary problems. 

 

Article 10. Intellectual property 

All elements of the website www.voltamobiles.com remain the exclusive intellectual property of VOLTA Mobiles. No one is authorised to reproduce, exploit, or use, for any purpose whatsoever, even partially, any elements of the website whether in the form of photos, logos, visuals or text. 

 

Article 11. Personal data 

VOLTA Mobiles undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Organic Law 15/1999 of 13 December. In this respect, the internet user has the right to access, modify and delete information concerning them. Article 12. Cookies

The website www.voltamobiles.com uses cookies for various reasons:

Technical: They are used to store information relating to the customer account, secure access to it and manage the shopping basket.

Personalisation: By recording the Customer’s browsing on the website www.voltamobiles.com and then enabling us to offer you the best VOLTA Mobiles offers.

Statistics: They allow us to compile statistics on visits to the website www.voltamobiles.com in order to improve its content and remain as close as possible to Customers’ requirements (pages viewed, date and time, number of visits, abandoned order process, etc.)

By accepting cookies when browsing the website, you are not exposed to any risk insofar as cookies do not allow the Customer to be personally identified.

Article 13. Dispute resolution

These distance selling terms and conditions are governed by Spanish law. For any disputes or litigation, the competent Court shall be that of Girona.
